A Note from the Board

Welcome to a new year at LHPM! We hope you had a safe and restful holiday season. We always strive to keep you updated on community matters, upcoming projects, and important reminders. Please review the highlights below and don't hesitate to reach out with any questions or concerns.

1. Dockmaster Status & Contact Info

  • Seasonal Hiatus: Our Dockmaster remains off-duty until April 1.
  • Contact the Board: If you notice anything that needs immediate attention or have any concerns, please email the Board directly at trustees@lhpmarina.org. We appreciate your cooperation during this transitional period.

2. D23 Foreclosure Update

  • Blind Bidding Process: The association-owned slip (D23), obtained through foreclosure, has been under a blind bidding process.
  • Successful Bid: We are pleased to announce that the winning bid of $24,500 exceeded the total amount owed. This outcome helps recoup costs and benefits the entire community.
  • Next Steps: The closing process is ongoing, and we will provide final updates once the sale is complete.

3. Engineering & Legal

  • Upper Deck Project: An engineer has been hired to conduct a thorough inspection of the upper deck repair project and provide expert reports for our ongoing counter-suit litigation.
  • Scope of Work: This engineer will also prepare a Scope of Work to guide the completion of the deck project.
  • Reserve Study: As required by New Jersey law, the Board is considering engaging the same engineer for a reserve study, ensuring our community remains financially prepared for future repairs and replacements.

4. First Quarter Assessment Reminder

  • Due Date: The 1st Quarter Common Area Assessment invoices are due no later than January 30.
  • ACH Withdrawals: Available through PMC and processed on the 15th of each billing month.
  • One-Off Payments: As outlined in the Uniform Collection Policy, you can also arrange a one-time ACH to avoid late fees.
  • Avoid Late Charges: Please ensure timely payment to help maintain consistent cash flow for community operations and improvements.

5. Dredge Permit Progress

  • Finalizing Pending Approvals: Water's Edge LLC will assist in completing the necessary edits to our previously approved NJDEP permit.
  • Army Corps of Engineers: The final step is to obtain approval from the Army Corps, as previous documentation was never fully completed.
  • Moving Forward: Once the permit is complete and all requirements are satisfied, the Board will revisit the dredging plans and schedules.

6. Proof of Insurance & Rental Guidelines

  • Insurance Requirements: All property owners, including those renting their properties, must maintain up-to-date proof of insurance with the association.
  • Signed Lease & Restrictions: Rentals require a signed lease agreement and Renter Restrictions document on file.
  • Fines & Responsibility: Owners are responsible for any penalties/fines resulting from a tenant violating the community's rules.
  • Winter Occupancy Checks: The association will reach out to confirm valid lease documents for any slip occupied during the winter to avoid unauthorized tenants.

Lighthouse Pointe Marina — October 2025 Owner Update Dear Owners, As the season winds down, we wanted to provide a comprehensive update on several important topics around the marina. Facility Updates The women's restroom door handle has been repaired and is now fully operational. Camera system upgrades are nearly complete. All new cameras are installed with proper data lines and improved coverage. The old system had aging, inadequate equipment, and questionable wiring. We expect the whole system to be live later this week. Wifi strength assessment will continue with a Spring contingency plan in place if needed. NJ State Police continue to investigate the theft of fishing gear reported earlier this season. Our old camera system captured partial footage that may help identify suspects. Please continue to secure valuables and report any suspicious activity to the NJ State Police and the Association. The majority of missing pylon caps have been replaced. Staff will continue to maintain and repair as needed. Storm Recap The October 12 nor'easter brought minimal issues to Lighthouse Pointe. While we experienced strong winds and elevated water levels, there were no reports of damage other than a slide pole on E-dock. A high-tide surge pushed water above the north bulkhead (Jetski area), but all docks and vessels remained secure. An additional high tide surge on October 13 , caused minimal disruption. Security and Access Gate codes were updated in October with new monthly numbering series. Please keep these codes confidential and share them only with your renters or authorized guests. We anticipate transitioning to annual updates in the future to assist in turnover management. Our dockmaster is working with an electrician to address any remaining lighting issues on the upper deck, parking lot, and around the docks. Years of questionable work on infrastructure make identifying root causes a challenge. The current Board will only work with licensed and insured contractors for these repairs in an effort to reduce future headaches. Slip Rentals and Lease Reminders Summer leases officially expire on October 15 . Any jet skis or small boats occupying Association-owned slips must vacate by that date in accordance with the deed. Owners who rent their slips for winter wet storage must submit a signed lease agreement and proof of vessel insurance before the renter's arrival. Please notify Dockmaster Jack to schedule new renter orientations and verify that all required documents are on file. Remember that any fines related to rental activity are assessed to the slip owner . Legal and Financial Matters September Financial reports are posted to the members portal. Litigation with Dreams Come True continues, with the next court date scheduled for November . The Association has retained Lockatong Engineering , one of the area's premier experts, to complete a full engineering report and provide expert testimony. Uniform collection efforts remain active. Two owners (covering four properties) are under repayment agreements, one account is in foreclosure proceedings, and the commercial property remains in foreclosure with arrears nearing $90,000 . The Association holds the first lien position , ensuring the accounts' debt will be paid first in any sale or sheriff auction. All other accounts are in good standing as of September 30 . Proof of vessel insurance per the master deed has improved substantially. Proof of insurance for 147 of the 150 vessels is obtained! Three owners have been issued $100 violation fines this month. Subsequent fines will be issued to any account that remains or become non compliant. All renewals, and cancellation notices are reported from the carrier to LHPM directly, a thirty day notice to cure will be issued for any expired policies - Owners are required to ensure the association has accurate information for their leased slips. Dredging and Permits We are pleased to share that the 10-year Army Corps dredge permit has received final approval pending the District Engineer's signature. Scarborough Marine is on retainer and preparing to begin maintenance dredging this winter - once the NJDEP confirms the mechanical dredge plans. This season's focus will be on opening the alley entrances between Docks B/C and C/D , with other high spots addressed as the budget allows. Our NJDEP permit must be renewed by June 2026 , and Water's Edge Environmental will assist with securing a five-year extension to maintain continuity in our dredging plan. Amendment to Master Deed Owners will be asked to approve an amendment to the Master Deed that would remove the existing restriction limiting alcohol service and consumption to the former restaurant property. This change would restore the right for owners and their guests to responsibly consume alcoholic beverages within the Association’s common and limited common areas, such as the clubhouse, provided all activity complies with state and local law. Specifically Paragraph 6(A)(49) , as previously amended, to deleted in its entirety and replaced with the following language: (49) Alcoholic Beverages.  Alcoholic beverages may be served and consumed within the association common areas as may from time to time be designated by resolution of the Board of Trustees of the Lighthouse Pointe Marina Condominium Association, provided that such service and consumption are conducted in accordance with all applicable municipal, county, and state laws and regulations. The Board of Trustees shall adopt and enforce reasonable rules and regulations governing the hours, conditions, and conduct related to the service or consumption of alcoholic beverages to ensure safety, compliance with law, and preservation of quiet enjoyment for all owners and residents. Nothing herein shall be construed to permit the sale, service, or distribution of alcoholic beverages by any unit owner, tenant, or other person except as specifically authorized by the Association. This Amendment supersedes all prior language of Section 6(A)(49) which restricted alcohol service and consumption exclusively to the restaurant commercial unit. Additional information on the rational and owners voting process will be shared in a separate formal communication. Winter Procedures As we transition into the off-season, thank you for your continued care of the property and commitment to keeping our community secure and welcoming. The Board will continue focusing on infrastructure, fiscal health, and capital planning to ensure steady progress through the winter months.With colder weather approaching, please review and prepare for the following seasonal procedures: Personal Belongings: All bicycles, hoses, and personal items must be removed from common areas and finger piers by the first week of November . Water Shutoff: Dock and pool house water systems will be turned off on or about the second week of November to prevent freeze damage. Clubhouse will remain accessible to owners in the winter. Staff Coverage: Seasonal staff coverage will conclude on November 24 . After this date, the marina will operate on an off-season maintenance schedule with limited onsite personnel. Lighthouse Pointe Marina — August Newsletter From your Board of Trustees August at the marina has felt like turning a corner. You can see it in small moments around the pool. The new coded gate and required bracelets have made the space feel secure, and the fresh furniture has turned quick dips into real hangouts. Inside, the clubhouse stays busy with cool air, better seating, and easy streaming for a ballgame. It is simple stuff, but it adds up to a place that feels cared for. You can also hear the difference in our meetings. Hosting sessions both in person and on Zoom has brought more voices into the room. Questions land sooner, answers are more precise, and neighbors who could not make it before are now part of the conversation. That is the kind of transparency we are working toward. On the financial side, the trend line is encouraging. More owners are paying on time, and only a small share remains in arrears. When accounts do fall behind, we follow the Uniform Collection Policy so everyone is treated fairly. Fines, liens, and foreclosure are never our goal, but they remain necessary tools that protect the community. Insurance compliance has improved as well, which helps keep people, property, and the association safe. Taken together, reserves are funded, and net assets are roughly $150,000 higher than this time last year. That progress lets us keep chipping away at long-standing maintenance needs without losing sight of the budget. Permits for winter dredging remain on schedule. Scarborough is lined up to begin targeted maintenance this winter, a steady, cost-effective approach that should keep depths improving, especially when combined with consistent boat traffic. Up on the deck, Lockatong Engineering completed an inspection this month and is preparing a full report. Their work will guide the final plan for the project and support the association in the ongoing litigation involving prior contractors. Early signs are positive and should strengthen our counterclaim. Election season is underway. Nomination notices have gone out, and ballots will follow by mail shortly. Please keep an eye on your mailbox and return your vote promptly. It matters. None of this is flashy, and we know there is more to do. Still, the pace is steady and the direction is right. Community Highlights July 4 Community BBQ More than 100 owners mingled from 6 PM to 8:30 PM, with a great turnout and even better company. A 50/50 raffle raised $210 toward new pool furniture. Shout-outs to Steve McEntee and his daughter for donating DJ services and the ice-cream truck, and to every volunteer who handled setup, breakdown, and cleanup. The Events Committee is already brainstorming another gathering. Stay tuned! Financial Snapshot & Assessments May Financials are available in the Members Portal; July statements will follow before the next meeting. Quarterly Invoices for common expense assessments are due July 15; payments received after July 30 incur a $100 monthly fine per the Uniform Collection Policy. Enroll in ACH drafts through PMC to avoid late fees (form and PMC contacts under “Trustees & Staff” on the website). Safety & Security Updates New Door Code: All clubhouse & pool-house keypads now use the new code (Shared via E-mail). Old codes are deactivated. Pool Access Bracelets: Custom 2025 silicone bracelets are available for authorized access to the pool area. Request yours from Secretary James Mangan or our volunteer Elaine on B-Dock. Pool Gate Upgrade: A new coded gate will be installed within the next 10 to 14 days to enhance security. Projects & Infrastructure Upper-Deck Railing The independent contractor is installing and painting the pipe railing; weather delays slowed progress, but completion is near. Work beyond the steps and up to the restaurant will follow minor ramp-support repairs. Engineering & Litigation Support Professional engineer Lockatong was engaged to audit prior deck work (Dreams Come True) and serve as an expert witness. This partnership keeps the long-term repair plan moving even while litigation proceeds. Dredging Permits are in the final approval stage with the Army Corps. Contractor Scarborough is on standby to start maintenance dredging this fall, focusing first on humps at fairway entrances. Regular boat traffic is already helping scour fairways, and we’re optimistic for deeper water once targeted dredging begins. Amenities Round-Up Clubhouse Upgrades: New HVAC, donated furniture, an energy-efficient refrigerator, and Roku/YouTube TV have made the space a popular cool-down spot, remote work space, and a great way to watch the Phillies. Remember to tidy up after use so that everyone enjoys a clean and comfortable environment. Governance & Meetings Next Board Meeting: Sunday, July 20 @ 10 AM, Clubhouse (in-person). We’ll also attempt a live Zoom stream using our new A/V gear. July Financials and meeting packet will be posted in the Members Portal ahead of the session. Quick July Reminders Check Your Bilges: Heat waves can stress pumps and batteries. Pump-outs: Our dockhand, JT, performs routine weekly pump-outs on Sunday morning. If you are underway at that time or need an off-cycle pumpout, do not hesitate to request it from the staff. Return Dock Carts: Please park carts in the designated area after use. Report Concerns: If you notice something that requires attention, please contact the Dock Master or the Board of Trustees; email is always a good option. LHPM April Newsletter From Your Board of Trustees The Board knows that association members are restless, and some may even be frustrated given the critical responsibilities and decisions in front of us all, from finishing the upper-deck legal saga to locking in a solution to maintenance dredging and managing reserve funds, all while handling day-to-day upkeep. We’re tackling each item carefully, putting safety and compliance first, and squeezing every assessment dollar to stretch as far as it’ll go. Progress can feel slow, but each small step moves us toward a sturdier, prouder community. Thanks for sticking together and exhibiting trust in this process. We’re confident we’ll keep Lighthouse Point moving in a positive direction. 1. Personnel & On-Site Operations Dockmaster – Jack Returned to duty on 4/1 and continues to handle spring start-up responsibilities and maintenance. Seasonal Dock Hand – JT Back for the 2025 season to support daily dock and grounds operations. Contract Services – Russ Not rehired full-time, but available on an independent contractor basis for specialty projects. 2. Projects & Infrastructure Upper Deck – Engineering & Litigation The Hyland Group will be on-site to provide a final report by mid-June . Findings will guide both litigation strategy and completion plan. State-Required Reserve Study Will begin as soon as the Hyland report is issued. A November 2024 preliminary review will serve as a baseline. Dredge Permit Water’s Edge LLC is finalizing permit updates and securing a 10-year Army Corps extension. Dredging cannot start before September 2025 ; schedule to follow once permits are complete. HVAC Repairs Contract awarded; work begins in May to replace air and heat in the clubhouse and the bathrooms. Upper Deck – Temporary Railing Replace with existing materials - installation slated for May . A permanent solution will only be prudent following litigation and reserve-fund planning settlement. 3. Please review the March report to better understand the associations current assets. Q2 Assessments Due April 15 ; late after April 30 per the Uniform Collection Policy. Delinquencies Arrears continue to decline overall; a few significant accounts have progressed to lien and pending 180-day late foreclosure actions in May. Slip D23 Sale Closing stalled due to a deed defect; legal counsel is clearing the issue. A new blind-bidding round will open once the title is fully cleared. 4. Dear LHPM Owners, As we settle into the quieter winter season, we’d like to take a moment to update you on the latest developments within our community. We appreciate your ongoing involvement, understanding, and commitment to making LHPM a wonderful place to enjoy life by the water. Personnel Updates Seasonal Staffing Adjustments: As we do each year, our full-time staff members Russ and Jack have been laid off in November. In 2025, we will be cutting payroll expenses by transitioning Russ into a 1099 contractor role, as-needed. This ensures we’ll may still have his expertise available, while maintaining fiscal responsibility. JT will remain on a part-time schedule throughout the winter, working two days each week (up to 10 hours total). His duties will include property walk-throughs, mooring line and bilge checks, spot-cleaning in the Clubhouse, and promptly reporting any concerns back to the Board. Ongoing Oversight: While the property will have limited on-site staffing, members of the Board of Trustees will also stop by periodically for inspections. As always, we value your feedback. If you have any concerns, please don’t hesitate to reach out at: trustees@lhpmarina.org Operational Updates Deck Litigation: The deck litigation process continues, with the formal discovery period wrapping up on February 7th. We will keep you informed as we move forward. Engineering Assessment: We have engaged an engineer to conduct a thorough evaluation of the upper deck repairs and to create a clear Scope of Work for final completion. This ensures that when the time comes to move forward, we will do so with a well-defined plan supported by expert advice. Dredge Permits: Our NJDEP dredge permit requires finalization with the Army Corps of Engineers. Our consultants at Water’s Edge are leading this effort. We will refrain from any dredge-related activity until all proper documentation and approvals are obtained, ensuring we follow best practices and meet all necessary regulatory requirements. Winter Clubhouse Access: Owners who wish to use the Clubhouse this winter can request lockbox access by emailing info@lhpmarina.org. If you choose to use the facility, please remember that you are responsible for leaving it clean and returning the key afterward. Please note that winter leases do not guarantee Clubhouse amenities, so this is an optional convenience rather than a guaranteed service during these months. D23 Unit Update: The deed-in-lieu of foreclosure for D23 is now finalized. Owners have the first right of refusal to submit a purchase bid by December 31, 2024. Please refer to the email sent by our Secretary for more details. Board Updates Vacant Board Seat: We appreciate the thoughtful submissions from qualified owners interested in filling the vacant Board seat. The Board plans to review and finalize a nomination at our Executive Working Session on December 12, 2024. We look forward to welcoming a new member to our dedicated team and continuing our mission to serve the community effectively. 2025 Budget and Assessment: After careful consideration, the Board has approved the 2025 budget and an assessment increase starting in Q1 2025. Going forward, annual increases will generally align with the Consumer Price Index to maintain financial stability and support our reserve funds. This year’s additional increase helps ensure we can meet our operational goals and continue improving LHPM for all owners. Delinquency Management & Financial Health November Financials to be posted in the members portal by 12/18 Receivable Balance improved by $36,411 (12/02: $48,466 vs 11/01: $84,877) We are pleased to report that increased clarity, consistent communication, and a compassionate approach have continued to improve our community’s financial health. Reducing arrears not only improves cash flow for operations and upgrades but also fosters a more positive environment for everyone. At a Glance: 26 Properties (8 Owners / 21% of Ownership) are currently in arrears. 3 of 26 Properties Liened (1 Owner / 2.21% of Ownership) remain in arrears. 8 of 26 Properties (3 Owners / 5.47% of Ownership) have approved monthly installments. 18 of 26 Properties (4 Owners / 15.65% of Ownership) are approaching lien status. These figures show that while challenges remain, our shared efforts are making a difference. Together, we can continue to lower these numbers and strengthen our community’s financial stability. Activity Since Election Financial Management Property Management Review: Analyzed current service model and identified gaps with PMC. Insurance: Authorized current renewal payments while positioning for competitive bid options for additional renewals in April. Delinquent Accounts: Implemented a uniform collection policy in line with clear standards for escalating to liens and foreclosures. Financial Review: Conducted a thorough analysis of financial statements, including delinquencies and accounts payable. Assessment Analysis: Reviewed operating and special assessments for sustainability. Budget Planning: Drafted the 2025 budget and three-year financial plan. Governance Master Deed Review: Ensured board members are familiar with governing documents. Officer Elections: Elected President, Vice President, Secretary, and Treasurer. Meeting Cadence: Scheduled quarterly owners' meetings and recurring working sessions. Board Transition: Engaged with previous board members for updates on key issues (deck, dredge, HVAC, bulkhead, pool) and facilitated access to communication channels. Legal Counsel Meeting: Reviewed active litigation and existing contracts. Operations Dock Master Position: Developed a job description and performance survey with a clear decision-making matrix (expenses capped at $500). Competitive Quote Policy: Established standard procedures for obtaining quotes for major repairs. Communications Community Involvement: Initiated a monthly letter to owners and developed strategies for increased community engagement. Foreclosure Process: Finalize foreclosure on D23 and accept deed in lieu of foreclosure, with plans to list at fair market value. Engineering Review: Engage a professional engineer for deck replacement oversight. Necessary for the ongoing litigation and future completion of repairs. We thank Kurt for his service and wish him the best moving forward. In accordance with our bylaws, the remaining trustees will fill this vacancy by majority vote at a special meeting. We encourage any owner in good standing who is interested in serving on the Board to submit a letter of interest to the Board by November 1st. This is an excellent opportunity for those passionate about contributing to the future of our community. Meeting Schedule We are committed to ensuring transparency and communication with all owners. We will begin virtual meetings in November, with in-person meetings at the clubhouse resuming in May. The Trustees have set the following schedule for open meetings: Thursday, November 21, 2024 – Virtual Thursday, January 25, 2025 – Virtual Thursday, March 20, 2025 – Virtual Sunday, May 17, 2025 – In-Person at the Clubhouse Sunday, July 19, 2025 – In-Person at the Clubhouse Sunday, September 20, 2025 – In-Person at the Clubhouse Upcoming Priorities As your newly elected trustees, we are eager to work collaboratively with the community and our key partners to address the immediate needs of Lighthouse Pointe Marina. In our first 30 days, we will focus on the following key areas: Board Onboarding : Review bylaws, NJ statutes, and fiduciary responsibilities. State of Affairs : Engage with our legal counsel, property manager (PMC), and other key stakeholders to assess ongoing matters. Reserve Study : Initiate an updated reserve study to plan for future capital improvements and inform the 2025 budget. Formalize Processes : Establish clear procedures for repairs, bids, collections, and other operational matters. Dockmaster Role : Finalize and publish the job description for our Dockmaster position. Owner Communication : Develop a regular monthly communication system to keep all owners informed of ongoing developments. A Positive Path Forward We are excited about the future of Lighthouse Pointe Marina. Though transitional leadership requires time to take effect, we want to assure you that we are actively working to address both immediate and long-term needs.
